Welcome to Recruiting BD. These Terms and Conditions (“Terms”) govern the relationship between Recruiting BD (“the Agency”) and the Employer (the “Client”) or the Job Seeker (“the Candidate”). By utilizing our services, you agree to comply with and be bound by the following terms.
1. Scope of Services
Recruiting BD provides human resource consultancy and manpower recruitment services, including but not limited to sourcing, pre-screening, trade testing, medical coordination, and visa processing for Bangladeshi personnel intended for overseas employment.
2. Employer Obligations (The Client)
To initiate the recruitment process, the Client must provide the following legally attested documents as per the requirements of the Government of Bangladesh:
Demand Letter: Specifying categories, quantities, salaries, and benefits.
Power of Attorney: Authorizing Recruiting BD to act on the Client’s behalf.
Service Agreement: Outlining the specific commercial terms of the project.
Employment Contract: A specimen of the contract to be signed by the worker.
3. Agency Obligations
Recruiting BD agrees to:
Source candidates matching the job descriptions provided by the Client.
Conduct preliminary interviews and technical assessments.
Ensure all deployed candidates are cleared by the Bureau of Manpower, Employment and Training (BMET).
Provide pre-departure orientation to all candidates regarding the host country’s laws and culture.
4. Recruitment Fees & Payments
Transparency: Recruiting BD adheres to ethical recruitment practices. Any service fees charged to the Client shall be agreed upon in writing prior to the commencement of the project.
Invoicing: Standard payment terms are [Insert Terms, e.g., 50% upon selection and 50% upon visa stamping], unless otherwise specified in the Service Agreement.
No Candidate Fees: In accordance with international labor standards, Recruiting BD strictly prohibits the collection of unauthorized “placement fees” from candidates for certain categories/territories where the “Employer Pays” model is applicable.
5. Candidate Guarantee & Replacement Policy
We stand by the quality of our talent.
Probationary Period: If a candidate is found to be professionally incompetent or medically unfit within the first 90 days (3 months) of deployment, Recruiting BD will provide a one-time replacement for that position at no additional service charge.
Exclusions: This guarantee does not apply if the candidate is terminated due to company downsizing, change in job description, or maltreatment by the employer.
6. Medical & Security Clearance
Every candidate undergoes a comprehensive medical examination through GAMCA or government-approved medical centers. While we take every precaution, the Agency is not liable for medical conditions that develop after the candidate has successfully passed initial screenings and arrived in the host country.
7. Confidentiality and Data Protection
All information shared between the Client and the Agency, including candidate CVs, corporate trade secrets, and salary structures, shall be treated as strictly confidential. Recruiting BD complies with the Data Privacy standards of Bangladesh and the relevant international jurisdictions.
8. Limitation of Liability
Recruiting BD acts as a facilitator between the Employer and the Employee. While we conduct rigorous vetting, the Agency shall not be held liable for any loss, damage, or legal disputes arising from the candidate’s performance or conduct once they have entered into a direct employment contract with the Client.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the People’s Republic of Bangladesh. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh.
10. Termination
Either party may terminate a recruitment project by providing [Insert Days, e.g., 30 days] written notice. The Client remains liable for any administrative costs incurred by the Agency up to the date of termination.
